Judge schools Fox and Friends on why Trump’s birthright citizenship plans are so ignorant

Judge Andrew Napolitano sat down with his friends at Fox and Friends
this morning to let them know why Trump’s plan to end birthright US
citizenship to babies whose parents are non-citizens or unauthorized
immigrants is uninformed.

“Look, the president can’t change the plain meaning of the
Constitution with the stroke of a pen,” the Fox News senior judicial
analyst explained.

Earlier this week, in a clip from the upcoming Axios on HBO, Trump boasted how he would change the 14th amendment with an executive order.

This clip makes for a great explainer video not just for Trump (who
needs it most), but for anyone who wants to understand how US
constitutional law is supposed to work.

We almost impeached a president for cheating on his fucking wife but we can’t even impeach Trump for putting children in fucking cages

It’s worse than that. We didn’t almost impeach Bill Clinton. Bill Clinton was impeached–the senate just ruled to keep him in office.  

And what we impeached him for was perjury and obstruction of justice. 

Aka lying and getting in the way of official investigations.

You know. The things Trump has been doing since day one. On live TV and twitter. Where we have fucking proof of it. 

Yet here we are. And there he fucking still is. 

This is why we have to vote this November, guys. We have got to take back congress. Trump will almost certainly be impeached if we can get enough seats back. 

Please please, I beg of you. Even if you don’t love your democratic candidates this November; even if they’ve done ‘problematic’ things in the past–please vote. The people who sat it out in 2016 because they didn’t love Hillary, or were bitter about Bernie, or fucking voted third party–they are the ones who carry the weight of this administration. The republicans went in undivided. The democrats went in split. And now children are being torn from their families, legal citizens are being deported, and we have fucking Nazis on the rise again.

I get that you want your politician’s views to align perfectly with yours. I do. But sometimes in politics you have to chose the lesser of two evils. We didn’t do that in 2016. 

I beg of you. Do it this year. 

You may not be able to find a progressive candidate whose ideas precisely align with yours…but I PROMISE you that the fascist racist misogynist white supremacists have candidates whose ideas EXACTLY align with theirs.

Jeff Sessions was interrupted by a priest who just directly quoted Jesus at him. Jeff Sessions was speaking about not allowing refugees and immigrants into this country.

The priest was removed. Another religious leader stood up and defended the priest, and they were also removed.

Powerful video. Jesus loves that priest, and that priest knows Jesus.

The other minister is a Baptist pastor, Rev. Darrell Hamilton, who I went to school with at Wake Forest Divinity.

Trump intends to sign an executive order ending “birthright citizenship”—the
right of people born in the United States to citizenship irrespective
of their parent’s status, as guaranteed by the 14th Amendment to the
U.S. Constitution.

MSNBC:

Trump, in an interview with Axios, part of which aired
Tuesday morning, said birthright citizenship “has to end” and that it
would, “with an executive order.”

“We’re the only country in the world where a person comes in, has a
baby, and the baby is essentially a citizen of the United States for 85
years with all of those benefits,” Trump said. “It’s ridiculous. It’s
ridiculous. And it has to end.”

“It’s in the process. It’ll happen with an executive order,” he said,
adding that he’s consulted with the White House counsel on the matter.

It’s annoying to watch him claim that the U.S. is the only country to
have birthright citizenship and the Axios interviewers just sit there
slack-jawed and clueless. I know we can’t be expected to rebut every
dumb lie instantly but… we’re not sending our best.

“Repealing” the 14th Amendment, which gave citizenship to former slaves after the Civil War, by Executive Order… that surely won’t be used to target the citizenship of anyone but the children of those scary immigrants that he keeps lying about, right?

For my Canadian friends (cc. @allthecanadianpolitics), the Conservative Party of Canada recently voted to add abolishing birthright citizenship to their party platform. So this isn’t just an American issue.

“One thing I think major outlets got right about “what did 2016 mean” and “how did Trump get votes” was that a lot of people (yes, even if we don’t want to address it or we think they shouldn’t be how they are) are/were on the losing side of popular culture wars like abortion, gay rights, minority rights, changing demographics reducing their real or believed power or prominence, and very real economic futures (coal country, for example; industrial workers, etc.). These people aren’t homogenous, but they have a lot of folks who have spent the last decade or two feeling shit on by a liberal America. Not by “liberal America”, like just a group IN America on the left, but by the very real America we have today that is–by and large–very liberal–and the popular culture we have that praises that. Our movies, TV shows, music, celebrity (both in entertainment AND in conventional academic or enterprising ways) all snub the idea of being uneducated, racist, bigoted, homophobic, anti-choice, Dominionist Christian, living in fly-over country, etc. They don’t care about policy. They care about someone slapping back against those things/forces/institutions/people that have made them feel like they’re culturally marginalized. They see Political Correctness and all that as more ways of slighting them. They see America as a zero sum game where raising anyone else up means taking from them. They’re tribal, sensitive, and feel under-represented. […] These people don’t care about policy. They don’t know anything about policy. They don’t “get” the social contract and how artificial all and any government is–that its not ordained, there is no governing Bible, there is no magical perfect society… that public policy is the intersection between what the people (at that moment in time) want and need AND what rules can be made to deliver them. Wants and needs and Rules change all the time. They’ll change in the future. They’ve not the same as they were even 20 years ago. And because of that, the best plan is to have the best experts advise on what to do and how and hear from as many people as possible from all walks of life. They don’t care about that. Policy is boring. Messy. You can’t put it on a coffee cup or hat. It makes them feel stupid and small and weak. They don’t know anything about fixing economies, they know tag lines. They don’t know anything about ultra-modern science and risk analysis, they know the weak-milky-coffee version of “I’m smart, tho” that is rampant, ignorant skepticism.”

He’s doing the job they want–the only job they understand. He’s entertaining to them, is hurting or disturbing their “enemies”, and makes them feel better about how shitty they are.

There’s going to be a bloody Civil War in America because of Donald Trump and the people he has empowered to be racist, misogynist, revanchist, hateful, and disdainful of civil rights and progress.
